Dr Stephen Opuni’s motion put on hold

A motion by former Chief Executive Officer (CEO) of COCOBOD, Dr Stephen Kwabena Opuni for the Attorney- General to make available all documents that would be relied on during his trial, has been put on hold.

This follows a pending case on similar grounds at the Supreme Court for an interpretation on Article 19(2)E and G of the 1992 Constitution. 

The said Article, mandates a person charged with a criminal offence, be given adequate time and facilities for preparation of his or her defence. The decision of the apex court will be binding on all Lower Courts. 

Counsel for Dr. Opuni, Samuel Codjoe filed an application demanding all documents the AG intends to use as evidence against Dr. Opuni, but the AG only gave partial information. 

Presiding Judge, Justice Clement Hoenyenuga, a Court of Appeal judge sitting with additional responsibility as a High Court judge, said the NCA has a motion before the Supreme Court bordering on the interpretation of the same Article and would therefore not be expedient to file the same motion twice. 

He said the decision of the Supreme Court will be binding on matters on the same issue. 

Dr. Opuni and the CEO of Agricult Ghana Limited, Seidu Agongo are standing trial for allegedly causing financial loss of more than 271 million cedis to the State.

The two at the previous appearance pleaded not guilty to all twenty-seven counts of charges. Benson Nutsukpui, is with Dr. Opuni's legal team.
