Businessman Sues University Of Education And Education Ministry Over Governing Council Mandate Extension

A Businessman and former Assembly man for Donkoryiem Electoral Area in the Effutu Constituency Supi Kofi Kwayera has filed a suit at the High Court in Winneba against the University of Education Winneba and the Ministry of Education over the extension of the mandate of the University’s Governing Council. 

He is praying the Court to grant him thirteen reliefs including a declaration that the extension of the mandate of the Council of the 1st Respondent by 2nd Respondent to stay in office to perform such functions as properly appointed. 

Council was in breach of section 8 of Act 672 and a declaration that all decisions taken by the defacto body of persons who constituted themselves as Governing Council are null and void and are of no effect. 

According to the suit the University with Authority from the Ministry of Education in November 2009, constituted a Governing Council which was to last for two years. 

After the end of the tenure of the Council, the University renewed the mandate for two more years which expired in November 2013. 

The 2nd Defendant, Ministry of Education failed after the second expiration to constitute a new Governing Council for the University but rather allowed the defunct Council which had no mandate to continue to make appointments, approved expenditures and conferred various degree during the period as if it has been properly constituted. 

The Court is expected to go into the case on the 5th of next June, 2017.
