Supreme Court advises AG’s Department to be Professional in approach to cases concerning State The Supreme Court has granted a motion by the Attorney General to file its statement of case within 14 days. Chief State Attorney, Sylvester Williams who moved the motion said the Attorney General is out of time because it had to conduct further search for some vital information on the case challenging the procedure used in the appointment of two judges to the Supreme Court. The court presided over by Justice William Atuguba was unhappy with the procedural errors on the part of the Attorney General noting that the AG as the leader of the Bar should demonstrate best practice. It also frowned on the practice by the AG to pray for an extension of time in constitutional matters involving the state. Counsel for the GBA, Thaddeus Sory was not opposed to the motion but was concerned about the AG representation for the Judicial Council which is the second defendant. The Supreme Court was scheduled to hear the Ghana Bar Association’s petition including two similar ones by Richard Skyy and a private lawyer Kwasi Danso Acheampong challenging the appointment of two judges to the Court. In the view of the GBA, the appointment of Justice Yaw Apau and Gabriel Pwamang by the President is in violation of recommendations by the Judicial Council. The GBA is seeking the Supreme Court to declare the processes the President used in appointing the two justices as unconstitutional and therefore the Supreme Court should declare it null and void. The case on the first hearing was adjourned to allow the AG and lawyers of the Bar Association to file all their processes to enable hearing to start fully.
